Legal principles of administrative liability for traffic violations in Ukraine

Abstract

The article defines the essence of the legal principles of administrative liability for traffic violations. An analysis of scientific approaches to the interpretation of legal principles in the administrative-legal doctrine is carried out. It is established that the legal principles of administrative liability for traffic violations are not only a regulatory framework that establishes the basic provisions and regulates the relevant legal relations but also serve as an ideological and methodological platform for the formation of a system of principles, approaches and mechanisms for the implementation of administrative liability. Methodology. The scientific research is based on both general and special methods of scientific knowledge. In particular, the method of documentary analysis and formal-legal and analytical methods have been used in the process of analysing the provisions of individual regulatory legal acts, in particular the laws of Ukraine, as well as international documents that form the basis of the studied system of legal principles, as well as the works of domestic scientists, which provide a critical analysis of these provisions. Structural-logical and system-functional methods have been used to analyse the features of the studied legal principles, their role in the process of dynamic regulation of the road safety sector, promoting the implementation of modern law enforcement standards, the formation of preventive measures, the inevitability of punishment and the protection of the rights of all road users. Results. The article states that legal principles create a theoretical and value basis for improving the organisational and procedural components of the Institute of Administrative Responsibility, which, in turn, increases the effectiveness of interaction between competent authorities and meets the requirements of the European legal space. It is proposed to understand the legal principles of administrative responsibility for traffic violations as a system of principles, norms and mechanisms that ensure comprehensive, dynamic and fair regulation of social relations in the field of road safety, aimed at preventing offences, the inevitability of punishment, the protection of citizens rights and effective interaction of competent authorities in accordance with modern standards and requirements.
